Peggy Sheahan Knee co-authored the brief and argued on behalf of the New Jersey State Bar Association as amicus curiae in the Matter of Mildred Keri, which concerns the ability of a guardian to make gifts on behalf of a mentally incapacitated person. In a unanimous decision, the New Jersey Supreme Court ruled that the guardian was authorized to make gifts on behalf of his or her incapacitated ward for the purpose of Medicaid spend down, and cited the New Jersey State Bar Association’s brief in their decision.
