A fiduciary is a person to whom property is entrusted for the benefit of another, such as a Trustee, an Executor, a Guardian or an attorney in fact under a Power of Attorney. Along with the authority given to the fiduciary, there are certain fiduciary duties. Litigation can arise when a fiduciary violates those duties or is accused of violating those duties.
